Eric Neiman and David Ryan Author Article on Punitive Damages Against Healthcare ProvidersPortland, OR. (March 8, 2010) – Portland Member Eric Neiman and Of Counsel David Ryan are the authors of an article published in Physician Organizations and AAOS Now, entitled, “Punitive Damages Against Healthcare Providers in the Healthcare Reform Era.” The article focuses on the use of punitive damages in litigation, recent limits to punitive damages imposed by Supreme Court rulings, and the effects of tort reform on curtailing punitive damages. Tort reform at the state level has led to greater restrictions on punitive damages, the authors explain, noting that a study conducted by the Congressional Budget Office (CBO) shows that, “since 1986, a total of thirty-four states (have) enacted at least one form of statutory restriction on the recovery of punitive damages.” |
