Medicare Secondary Payer Response Team

Self-insured entities, liability insurers and other primary payers must address the many issues presented by the new mandatory reporting obligations under Section 111 of the Medicare, Medicaid and S-CHIP Extension Act (MMSEA)--a ringing reminder of their long-standing obligation to reimburse Medicare under the Medicare Secondary Payer Act (MSP). Many may still be uncertain of what these obligations are, what the penalties for failure to comply include, and how these laws impact claims and litigation involving claimants who may be Medicare beneficiaries.

Williams Kastner has formed a Medicare Secondary Payer Response Team to assist our clients in understanding these, at times confusing, laws and requirements. Our lawyers understand the history and the intent of the legislation. Our Response Team is prepared to advise our clients on these matters and avoid risk exposure due to non-compliance. Re Knack, leader of the Williams Kastner Medicare Secondary Payer Response Team, is also Chair of DRI's Medicare Secondary Payer Task Force. DRI is the largest international association of the defense of civil litigation.
