Insurance Experience
Ms. Knack's insurance practice includes litigation and legal advice relating to insurance coverage and bad faith for policyholders and the insurance industry including property and casualty, life, health and disability. Ms. Knack also provides guidance and advice to the insurance industry and self-insureds with respect to their obligations under the Medicare Secondary Payer Act and Section 111 of the Medicare, Medicaid and SCHIP Extension Act (MMSEA).
Insurance coverage disputes of various kinds:
- Bad faith claims
- Drafting of insurance contracts
- Subrogation
- Contractual arrangements for captive/self-insurance programs
- Insurer claims handling and underwriting activity
- Compliance with reimbursement obligations under the Medicare Secondary Payer Act
- Compliance with reporting obligations under ยง111 of the MMSEA
Experience in coverage disputes for various lines of insurance, including:
- CGL coverage, including experience with many of the exclusions and other contractual provisions in the typical CGL contract, including bodily injury claims, property damage claims and construction defect claims
- Professional liability
- Health insurance (including coverage and subrogation)
- First-party insurance
- Disability insurance
- Insurance coverage for environmental and hazardous waste matters, including RCRA, CERCLA, environmental impact statement laws, soil and groundwater contamination matters
